Nicola Sturgeon finally begins the process of separation!
History may record that Britain finally died the day the UK Government decided to rip the European Convention on Human Rights from the heart of Scotland’s devolution settlement.
The leader of the group which drew up the Convention, in 1950, was a Scottish lawyer, Sir David Maxwell-Fyfe. As a prosecutor at the Nuremberg Trials, he had seen first-hand how international justice could be effectively applied to support universal rights for individuals. He guided the draft, which has influenced the understanding of human rights throughout Europe ever since.
At one time, this Convention would have been regarded as the bedrock of British values. But now the Government in Westminster seeks to cross out the bits it doesn’t like. It has declared its intention to remove these from the Scotland Act without the consent of the Scottish Parliament.
The Convention was used to halt a flight deporting refugees against their will to Rwanda, and now the UK Government intends to excise sections from British law. The changes it intends to make include removing the right to trial by jury – for individuals the Government doesn’t like.
The Bill makes clear that the UK Government intends to amend the Scotland Act of 1998 by replacing all references to the Convention with the UK Government’s own Bill – that will clearly have to take place without the consent of the Scottish Parliament. That shows a fundamental disregard for the principle that the devolution settlement would be respected, and should not be changed by Westminster against the will of Holyrood.
The UK Government has decided not to submit its Bill for pre-legislative scrutiny by the House of Commons or the Scottish Parliament. The UK Government has made it clear it doesn’t recognise any sovereignty for Holyrood so it doesn’t matter if the Scottish people and their representatives consent or not.
Those who voted No in 2014 believing assurances by Unionist parties that the devolution settlement would be respected have every right to feel betrayed.
Perhaps history will record that the values enshrined in the European Convention on Human Rights turned out to be Scottish values and that English values are rather different.
Therefore if this fascist UK govt has no respect for the Scotland Act or Scotland itself, why should the Scot govt and the Scot people continue with the Acts of Union???

After a week of Unionist Media "talking heads" and reports that there was no appetite in Scotland for independence, a bombshell poll dropped in last night lol Laugh Laugh
Scottish Labour, Tory and Libdem protagonists will have choked on their Tunnocks tea cakes when they read the Panelbase Research findings via The Times - it revealed Yes for indy in the lead and the Times senior reporters suddenly discovering that their bogus insinuations re lack of interest have been "blown out the water"!!! F### them and their "Project Fear II" campaign that has already been in overdrive following Nicola's dramatic announcement of intent!! It was a ridiculous state of affairs before these results and even more ridiculous after them that complicit anti-Scotland Unionist politicians will try to stand in the way of Scotland even having a say on our future outside of this toxic Union. From The Times to the Spectator, it is curious to observe the shit comments that are no longer "Better Together" ones any more, "pooling and sharing", economic "broad shoulders" etc etc. It's basically cheerleading a position that there is no time or place for a referendum poll!! Thumb down They are basically celebrating the suppression of democracy in perpetuity - THEIR POSITION IMO IS UNTENABLE AND THAT'S QUITE A SPACE FOR SUPPOSEDLY LIBERAL OR EVEN LEFT(ISH) PRESS OUTLETS LIKE THE GUARDIAN, THE TIMES, AND THE NEW STATESMAN. The sports pundit and National columnist, Stuart Cosgrove, recently noted: "Such is the grip that Unionism" has over Scotland's public discourse that our best journalists are required to argue that a bleak impoverishing and neo-racist Unionism is preferable to change - sadly true, but one has to wonder if there is any threshold to this behaviour?? How long does it take to defend this miserable state, and specifically the idea that democracy should be suppressed. And yet politicians like Johnson say the exact opposite when talking about the democratic rights of Ukraine and even the Falkland islanders who went through a politically driven "status (indy) referendum" all these years ago. Maybe that's what we Scots need to opt for as well although the two-pronged attack/indy proposal by our esteemed FM will suffice for now.

All these union leaning morons, potential Tory leaders, with a common theme that they "won't allow Scotland/the Scot govt to have a vote on their own democratic right to vote for Scotindy next year"??????????????????????????? Hunt - Not in the next ten years???????????? Tugendhat - No, it's a distraction, but no time deficit specified??? Moving to the referendum, how can just holding a referendum affect the UK constitution anyway???? If they hold a referendum, and the country votes to remain, then nothing changes and the constitution remains exactly the same plus the referendum has not interfered with it. Even if Scotland votes to leave , nothing changes. On the day after the result, we will still be part of the UK, bound by the same laws and subject to the same govt institutions. Again, the constitution will not have changed! All the referendum does is allow the people of Scotland to express an opinion. Therefore, since holding a referendum cannot change the constitution, WHICH IS WHAT IS RESERVED AT WESTMINSTER, then surely it can't be illegal to do something that doesn't interfere with a reserved matter??? It's only the actions taken after the referendum that affect the constitution. That's when Nicola goes to the Brit govt and asks to leave the Union, "Can we start negotiations"? The Brit govt then has one of two options - the PM can consent to change the constitution in such a way that Scotland doesn't need to remain a part of it - and begin negotiations. OR THE PM CAN REFUSE TO ALLOW SCOTLAND TO LEAVE I.E. YEARS OF PEACEFUL CAMPAIGNING FOR OUR OWN SELF-DETERMINATION HAVE FINALLY COME TO AN END AND GOD ONLY KNOWS WHERE THAT WOULD TAKE US!! Again, whichever way it goes, IT'S WESTMINSTER THAT MAKES THE DECISION TO CHANGE THE CONSTITUTION, BECAUSE THE CONSTITUTION IS RESERVED TO THEM. Scotland will not have interfered with that reserved matter. The way I perceive this now is that when the Scotland Act was mooted and the constitution was reserved to Westminster, the voluntary Union was relinquished and a compulsory Union was established - either we made a mistake in accepting such a qualification , placed on whether or not we can leave or must remain in this fractured Union of unequal partners, or we were craftily conned!!!!!! It seems we have, since that time, been obliged to remain as part of the UK UNLESS WESTMINSTER LETS US LEAVE - ABSOLUTELY OUTRAGEOUS IN A PROPER CIVILISED DEMOCRATIC SYSTEM OF COOPERATION. Therefore, reflecting back to line 5 of my thread, I think we should already be making representations to the United Nations who state that every country has the right to decide its own future - JUST LISTEN TO THAT COMMON REMARK BEING MADE BY BRIT GOVT AND LABOUR UNIONISTS RE THE STATUS OF UKRAINE AS A SOVEREIGN COUNTRY???????? It reeks of downright hypocrisy and different rules/obligation re a sovereign home country called Scotland. As it stands, it appears to me that we could well be powerless to leave unless we can get something established through the international courts. To my Scottish members on this board, I'll beg the question, "Am I just introducing complications where they don't exist"?

At long last, after about 10 days of the Tory media, the bbc, Tory leadership candidates (plus members of the current Tory govt) telling Scotland, the Scot govt/Scot people that "you are not permitted by me/us, on behalf of the Brit govt, to have a voluntary democratic vote on your own self-determination" - two Scotindy MPs, Kenny Macaskill and Neal Hanvey, vociferously slamming into Johnson and the rest of his anti-Scotland scumbags re their absolutely outrageous stance against a sovereign country they have no interest in whatsoever apart from "bleeding Bella Caledonia dry". We are regarded as a "soft touch" by these bastards and how wonderful to see "Scots who care" taking a stance on the issue re politicians from England who contemptuously believe they can "ride roughshod" over the Scottish constitutional issue ad infinitum. I think we are very close to "taking the gloves off" and taking on the Tory criminals who believe they can behave like this with no subsequent retribution. I hope Ian Blackford and his fellow MPs were watching very closely re the events unfolding, and the negative response from all the unionist MPs(the real offenders on this particular issue!!!!!) in the debating chamber, to a protest that was gonna be inevitable esp after the days n days of inciteful and undemocratic remarks that have hardly been challenged by the media presenters who were "fronting" many of these attacks. "Let the court decide", said Nicola Sturgeon after the latest attack by this fascist Brit govt in prompting the Supreme Court to chuck out the Scot govt's legal application for clarification on the Scot govt's power to conduct such a voluntary referendum vote. If they do kybosh it, many people/critics like myself question the legal validity of an English law court having some form of jurisdiction over the Scottish constitution and Scottish Law itself. Indeed there is no written constitution in England anyway and we are dealing with political morons who "rip up" treaties and are effectively law breakers. IMO we don't do it now to the anachronistic Treaty of Union 1707, but two can play at that game if forced to do so!!! Our Scot govt is trying very hard to follow proper due process - all nice n legally obliging, BUT WE ARE DEALING WITH A GANG OF POLITICAL CRIMINALS WHO HAVE NO MORAL COMPASS AND NO RESPECT FOR SCOTLAND OR THE RULE OF LAW!!!!!

To all pro Scotindy readers based in Scotland - note this target protest date, a "big one", organised by the AUOB movement - Tuesday 16 August is the Tory Party Leadership hustings date in Perth. The organisers wanna maximise the attendance at this event demonstrating against the Tories and the fact they have no mandate to rule in Scotland - INDEPENDENCE IS OUR DEMOCRATIC RIGHT TO DECIDE, NOT THEIRS!! This is one event that I'm certainly gonna try to get to as well as encouraging other friends and family members to do the same. We wanna see thousands n thousands of like-minded indy supporting Scots swarming all over this event and sending out a strong message that "YOU'D BETTER STOP MESSING ABOUT WITH YOUR UNDEMOCRATIC SHIT AGAINST SCOTLAND ONCE N FOR ALL"!! The biggest joke is the fact that both leadership candidates, Truss and Sunak, have previously favoured the basic tenet of having a referendum event such as the one being proposed - both of these people are unsurprisingly "shapeshifters"/hypocrites when it comes to preaching about this constitutional issue!! Last week on bbc radio, the ex Tory Attorney General, Dominic Grieve, absolutely slammed into Johnson as the most mendacious, corrupt politician/PM he had ever observed and the fact the clown prince had severely damaged the Conservative & Unionist Party beyond belief, insisting it would take decades to repair. Of course Grieve is no longer a Tory member, compliments of Johnson and his gang of Brexit criminals alongside him. Grieve's comments re the Scot constitutional issue weren't the best (as expected, he is clearly against Scotindy), but they were far more pragmatic and democratically honest than the previous comments from all these Tory decepticons "singing from the same pro-Union hymn sheet".

How intriguing watching the bbc being fully exposed in trying to suppress comments by the the Brummy comedian, Lycett, at the Commonwealth Games opening ceremony when introducing the Asian athletes commenting, "I'm going to do something now that the British govt doesn't always do, AND WELCOME SOME FOREIGNERS, THIS TIME FROM THE REGION OF ASIA"!! And the jingoistic reaction of the Essex audience at this Tory hustings was nothing short of astounding!!!!!!!!!!! I think a recorded video of this whole disgraceful episode should be broadcast to every Scottish citizen regardless of their political affiliation. The narrative literally sends out a message of antagonism and conflict v another "equal partner" (NOT!!!!!) of this failed Union that these Tory plebs, democracy deniers of the highest order, just can't "get their heads around" - the inevitable outcome is there for all to see AND THEY DESERVE IT AFTER THIS LATEST EXAMPLE OF POLITICS "FIT FOR THE GUTTER".
